One of the nuances that was introduced to us was the short sale/loan modification. At this time there were many things agents would tell clients that turned out to be less than true and they were subsequently sued by their clients.
For example, agents would tell their client that they had to go delinquent on their mortgage before they could be approved for a short sale (simply not the case).
Since then we are often asked by agents what they can do in order to best protect themselves. Because of what is at stake in a real estate transaction we recommend that agents have a real estate attorney on retainer in order to best protect them when (usually not "if") a legal situation arises.
